DOMESTIC VIOLENCE CRIMES

Crimes involving Domestic Violence are subject to special treatment under Florida Law.  Individuals sentenced for charges of Domestic Battery, for example, cannot seal their record, even if adjudication of guilt has been withheld and they are otherwise eligible.  Domestic Violence cases often present a series of issues absent in cases involving other crimes of violence, in large part due to the preexisting relationship between defendant and victim.

That relationship can make it particularly difficult for a Defendant to abide by the “no contact” condition of pretrial release imposed at first appearance after almost every domestic violence arrest, and each instance of contact in violation of the court’s order is a new, separate misdemeanor charge.  Because of the emotionally charged nature of domestic violence cases, and a potential lifelong criminal history irrespective of whether or not an individual is adjudicated guilty, it is critical for anyone accused of a crime of domestic violence to contact an experienced attorney immediately.
